Nothing Incriminating Was Recovered From His Possession: Allahabad HC Grants Bail To Individual Accused In U.P. Police Exam Paper Leak Case

The Court was hearing an application seeking the release of the applicant Monu Sharma on bail in a case registered under Sections 420, 467, 468, 471 and 34 IPC.

The bench of Justice Sameer Jain noted, “…as per allegation, applicant along with others involved in the offence of paper-leak, but it reflects that nothing incriminating was recovered from his possession and co-accused Monu Kumar and Rajneesh Ranjan, who was also apprehended along with the applicant, have already been released on bail…”

Advocate Ashwani Tripathi appeared for the Appellant and Brief Holder Manoj Kumar Singh appeared for the Respondent.

In the present case, the applicant Sharma argued that he had been falsely accused in the paper-leak case and was not involved in the alleged offence. He further argued that along with him, co-accused Rajneesh Ranjan and Monu Kumar were also apprehended but have since been released on bail by a co-ordinate Bench of the Allahabad High Court.

The Court perused the records and noted that the case of the accused is at par with the other two accused who were released on bail.

Further, however, the Court noted that apart from the present case, the applicant also has a criminal history in four other cases, but his entire criminal history has been explained in the present bail application and in all four cases, the applicant is on bail.

The Court further noted that all the alleged offences are triable by Magistrate-I class and the applicant is in jail for more than 2 months.

Accordingly, without expressing any opinion on the merits of the case, the Court allowed the bail application.
