Allahabad HC Orders Inquiry Into SHO’s Misconduct Allegations Of Mistreating Women And Assaulting Elderly At Police Station

The Allahabad High Court has issued directions to the Superintendent of Police in Sultanpur to initiate an inquiry into allegations of misconduct by a Station House Officer (SHO). The allegations presented in the current writ petition centered on the SHO's misconduct when the petitioners visited the police station to have their statements recorded

A Division Bench of Justice Sangeeta Chandra and Justice Narendra Kumar Johari acknowledging the circumstances, instructed the Additional Government Advocate (AGA) to seek instructions from the Superintendent of Police in Sultanpur.

A petition was presented before the high court, claiming that SHO in Kurebhar, District Sultanpur, had engaged in inappropriate behavior towards female petitioners. Additionally, it was alleged that he had physically assaulted the father of one of the female petitioners at the police station.

The Court was informed that that they had recorded the entire incident on their camera.

It was noted by the Court that the petitioner women themselves were named as accused in an FIR registered under Sections 353, 504, 506, and 34 of the IPC at Kurebhar Police Station, District Sultanpur.

The petitioners had previously challenged this FIR through another writ petition, and the high court had provided them with protection, following the directives laid out by the Supreme Court in the case of Arnesh Kumar v. State of Bihar (2014).

While conducting the inquiry, the Court directed the SP, Sultanpur, to also examine any available CCTV footage from Kurebhar Police Station before providing instructions to the AGA. The matter is scheduled to be heard next on September 26, 2023.
