Allahabad HC Directs Jail Superintendent For Report On Health of Former MP Afzal Ansari After He Seeks Bail On Medical Grounds
The Allahabad High Court while hearing a Criminal Appeal filed by Former Bahujan Samaj Party (BSP) MP, Afzal Ansari, directed the Jail Superintendent to furnish a medical report of the Appellant.
A Bench headed by Justice Raj Beer Singh stated that “Let a report be called for from the concerned Jail Superintendent regarding medical condition of the appellant by the next date.”
Advocate Upendra Upadhyay appeared for the Appellant while G. A Sudist Kumar represented the State.
The former MP from Ghazipur, Afzal Ansari is the brother of former MLA Mukhtar Ansari. On April 29, 2023, Afzal along with his brother were convicted under The Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act, 1986.
Mukhtar Ansari was sentenced to 10 years while Afzal was sentenced to 4 years imprisonment. Subsequently, Afzal was disqualified from his position as MP of Ghazipur Constituency by virtue of provisions contained in Article 102(1)(e) r/w Section 8(3) of the Representation of People Act 1951.
Afzal filed an Appeal in the Allahabad High Court against the verdict of the Special Court which was accepted on May 25, 2023. The next date of hearing was fixed for July 04, 2023.
During the course of proceedings on July 04, a special request was made by the Counsel for the Appellant seeking bail due to the ill health of the Appellant. It was stated that the Appellant is suffering from a heart ailment.
The Court taking note of the submissions ordered a report from the concerned Jail Superintendent regarding the medical condition of the appellant by the next date. The next date of hearing accordingly has been fixed for July 12, 2023.
