'Serious Matter': Delhi HC Directs Trial Court To Expedite Case On Haryana Civil Services Judicial Examination Paper Leak

Delhi High Court directed the trial court to expedite the matter involving the leaking of judicial examination papers.

The Supreme Court had transferred the matter related to the leakage of the Haryana Civil Services Judicial [HCS (JB)] examination paper from Chandigarh to Delhi.

The High Court pointed out the seriousness of the matter and directed the trial court to expedite the proceedings, ensuring the disposal of the matter on or before April 15, 2024. The parties agreed to cooperate for the expeditious trial.

Justice Dinesh Kumar Sharma observed, “This is a serious matter involving the leaking of judicial examination papers. The matter was transferred from Chandigarh to Delhi by virtue of the orders of the Apex Court. The learned trial court is expected to expedite the matter and take the same on a day-to-day basis.

Advocate Alok Bhachawat represented the petitioner, while Addl. PP Charanjit Singh Bakhshi appeared for the respondent.

During the submissions, the petitioner expressed a willingness to withdraw the petition, with the liberty to summon specific documents during the defence evidence. These documents include letters, summons, and emails related to the HCS(JB) Examination 2017 preliminary inquiry, sent by the Registrar Vigilance to various individuals and mobile companies.

The respondent suggested that the petitioner could file an appropriate application before the trial court during the defence evidence stage for further consideration.

The Court held, “In view of the submissions made, the present petition is disposed of with the direction that the petitioner shall be at liberty to move an appropriate application at the stage of defence evidence for summoning the aforementioned documents. Learned trial court shall decide the same in accordance with law.

The High Court disposed of the petition, allowing the petitioner the liberty to move an appropriate application at the stage of defence evidence to summon the specified documents.
