Clear Outstanding Salary Of Employees Of Delhi Waqf Board Within Two Weeks: High Court Directs
The Delhi High Court has directed the city government and the Delhi Waqf Board authorities to clear the pending salary of the employees of the said board within two weeks.
A Single Bench of Justice Jyoti Singh said, “… it is directed that the Respondents shall ensure that all outstanding dues of the employees who are members of Petitioner No. 1 as well as Petitioner No. 2 herein, are positively released within two weeks from today, failing which this Court will be constrained to pass adverse orders on the next date.”
The Bench has listed the matter for the next hearing on April 18, 2023.
Advocates M. Sufian Siddiqui and Rakesh Bhugra appeared on behalf of the petitioners while Advocate Tushar Sannu, Additional Standing Counsel Yeeshu Jain, and Standing Counsel Wajeeh Shafia appeared on behalf of the respondents.
In this case, a writ petition was filed by the petitioners i.e., the Delhi Waqf Board Employees Association and the employees of the Delhi Waqf Board. The grievance ventilated in the writ petition was that they have not been paid their salary and other allowances for over 6 months.
The High Court in view of the above observed, “Reading of the counter affidavit filed by Respondent No. 1 shows that there are inter se disputes between Respondent No. 1 and Respondent No. 3 and the only endeavour seems to be made is to pass the blame on each other for non-payment of the dues of the Petitioners, who have not received their emoluments for over six months now.”
The Court noted that the counter affidavit has been filed by the Chief Executive Officer of the Board, however, no counter affidavit is filed by the Delhi Waqf Board.
Accordingly, the Court issued necessary directions to the respondents.
