It’s Difficult For A Woman To Live Alone After Breaking Live-In Relationship: Allahabad High Court
The Allahabad High Court while hearing a bail application filed by a man who was arrested for not fulfilling his promise to marry a woman, i.e., his live-in partner said that it is difficult for a woman to live alone after breaking of a live-in relationship.
The Court observed that Indian society does not recognize such a relationship as acceptable and a woman is left with no option but to lodge FIR against the live-in partner.
A Single Bench of Justice Siddharth asserted, “… this is one case where the disastrous consequences of live-in relationship has come on the scence. It is difficult for a woman to live alone after breaking of live-in relationship. The Indian Society at large does not recognizes such relation-ship as acceptable. The woman therefore is left with no option but to lodge first information report against her live-in partner, like in present case.”
Advocates Anuj Srivastava and Tanmay Sadh appeared on behalf of the applicant while Government Advocate appeared for the State.
In this case, there was an allegation against the applicant that he maintained a live-in relationship with the victim for more than a year. The victim was earlier married to another man from whom she had two sons.
She became pregnant on account of a live-in relationship with the applicant. As per the victim, the applicant refused to marry her and sent her obscene photographs to her husband due to which he also refused to live with her. The victim was major and willingly entered into a live-in relationship with the applicant.
The High Court after hearing the rival arguments noted, “Keeping in view the nature of the offence, evidence, complicity of the accused, … the Court is of the view that the applicant has made out a case for bail.”
Accordingly, the Court granted bail to the applicant.
