Allahabad High Court Grants Bail To Man Accused Of Selling Sugarcane Juice Adulterated By Beef

The Allahabad High Court has granted bail to a man who was accused of selling sugarcane juice adulterated by beef.

The bail application was filed by the accused in connection to the case registered against him for the offences punishable under Sections 323, 504, and 295-A of the IPC and Sections 3 and 5 of the U.P. Prevention of Cow Slaughter Act, 1955.

A Single Bench of Justice Deepak Verma observed, “Considering the entire facts and circumstances of the case, submissions of learned counsel for the parties and keeping in view the nature of offence, evidence, complicity of accused and without expressing any opinion on the merits of the case and the law laid down by the Apex Court in Satendra Kumar Antil Vs. C.B.I. & Another, S.L.P.(Crl.) No. 5191 of 2021, the Court is of the view that the applicant has made out a case for bail.”

The Bench allowed the bail application of the accused on the ground that he shall not tamper with the prosecution evidence by intimidating or pressurizing the witnesses during the investigation or trial.

Advocate Hasan Parvez appeared on behalf of the accused while Government Advocate represented the State.

In this case, the accused was engaged in selling sugarcane juice. As per the counsel of the accused, a dispute arose between the parties regarding the payment of money and the informant implicated the accused in this matter on a concocted story.

The informant lodged the FIR against the accused. However, there was no FSL report of the alleged incident, which proved the prosecution’s story. The accused was languishing in jail since November 30, 2022.

The High Court after hearing the arguments of counsel said, “Let the applicant, Fuzail, who is involved in the aforesaid case crime, be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned subject to following conditions. Further, before issuing the release order, the sureties be verified.”

The Court directed that the accused shall cooperate in the trial sincerely without seeking any adjournment and not indulge in any criminal activity or commission of any crime after being released on bail.

Accordingly, the Court granted bail to the accused.
