Gujarat High Court Marks Arvind Kejriwal's Application For November 3 Against Summons Passed In Criminal Defamation Case
The Gujarat High Court has marked the Petition filed challenging the issue of the process initiated by the Trial Court against the AAP leaders Arvind Kejriwal and Sanjay Singh for November 3rd.
Justice J.C Doshi observed, “In view of the above submissions, NOTICE, returnable on 3rd November, 2023. Learned APP waives service for the Respondent-State. Direct service is permitted”.
Senior Advocate Rebecca John appeared for the Petitioner, and Public Prosecutor Divyangna Jhala appeared for the Respondent.
AAP Leader Arvind Kejriwal had allegedly passed defamatory remarks against the Gujarat University and sought the degree of Prime Minister Narendra Modi. The Registrar of the University, therefore, filed a criminal defamation case against the leaders. The Trial Court issues the process against the leaders. The Petitioner filed a revision petition, which the Sessions Court dismissed. The Petitioners approached the Court challenging the order of the Trial Court.
The Petitioners contended that the Registrar of Gujarat University, who filed a criminal complaint for defamation, was not an aggrieved party and therefore was not authorized to do so. They also contended that the impugned order failed to determine whether the alleged defamatory statement was libelous per se or by innuendo.
Accordingly, the Court listed the matter for November 3rd.
