Gujarat High Court Stays GNLU’s Order By Which It Suspended Its Student From Hostel

The Gujarat High Court stayed the order by which Gujarat National Law University suspended its Student from the hostel. 

The bench of Justice Aniruddha P. Mayee observed, “…impugned communication/notice dated 20.9.2024 suspending the petitioner from the Halls of Residence with immediate effect shall remain stayed till further orders.”

The Petitioner, a student at Gujarat National Law University, filed an Anti-Ragging Complaint with the UGC. Following an inquiry, the UGC directed the Respondent in the complaint to apologise to the Petitioner, but the order was not complied with. The Petitioner then raised the issue on the UGC's E-Samadhan portal, prompting the UGC to ask the University to take action. The Student Disciplinary Committee of the University issued a notice to the Petitioner to appear before them regarding a misconduct incident on which the Petitioner requested a postponement due to exams but was denied. As a result, he was suspended from the University hostel for non-cooperation with the SDC inquiry and was ordered to vacate the premises within 24 hours, which he complied with. The Petitioner challenged the suspension.

The Court directed the University to reinstate the Petitioner in the Halls of Residence to his allotted room with immediate effect on the receipt of the order.
