Madhya Pradesh HC Grants Bail To Congress Leader Raja Pateria In Case Over His "Kill Modi" Remark
The Madhya Pradesh High Court, Jabalpur Bench has granted bail to the Congress Leader and Former Madhya Pradesh Minister- Raja Pateria in a case registered over his remark, ‘Kill’ Prime Minister Narendra Modi to ‘save’ the Constitution.
The Bench of Justice Sanjay Dwivedi allowed the second bail application without commenting on the merits of the case.
Senior Advocate Shashank Shekhar appeared for the applicant and Deputy Government Advocate L.A.S Baghel appeared for the respondent-State.
In this case, the applicant had filed a second bail application under Section 439 of the Criminal Procedure Code, 1973 (CrPC). FIR was registered for offences punishable under Sections 451, 504, 505 (1) (B), 505 (1) (C), 506, 153-B (1) (C) added 115, 117 of the Indian Penal Code.
The earlier bail application was rejected on the ground that the words used for the Prime Minister was not acceptable that too in a public meeting. However, the Court granted liberty to resuscitate the prayer of bail by filing a new application after a period of thirty days from the date of the order.
The Court considered the earlier order and the liberty granted to the Leader, allowed the bail application upon him furnishing a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac) each with one solvent surety each of the like amount.
Accordingly, the application was allowed.
