Adverse Impact On Eco-System & Environment: Meghalaya HC Directs State To Ban Plastic Below 120 Microns
The Meghalaya High Court urged the State government to impose a ban on the manufacture, sale, and use of plastic materials with a thickness of less than 120 microns.
The case originated from a Public Interest Litigation (PIL) filed with the aim of completely banning plastic in Meghalaya. In August 2024, the Court had already ordered the State government to take immediate action to curb plastic usage within the state. In response, the Forest and Environment Department submitted an affidavit in September, outlining the steps taken to address plastic waste management. While acknowledging the efforts made, the Court noted that additional time was needed to fully comply with the directives issued in the August order.
A Bench of Chief Justice IP Mukerji and Justice W Diengdoh ordered that the State take immediate action by issuing administrative orders or enacting legislation, including subordinate legislation, to effectively ban the use and production of plastic materials that are less than 120 microns in thickness.
The State was also directed to seize such plastic materials from manufacturers, distributors, and users. Additionally, the Court emphasized the importance of implementing effective plastic waste management practices and urged the government to ensure that these materials are properly disposed of. The Court also instructed the authorities to conduct inspections in public spaces and take appropriate action against those using or disposing of such plastic in violation of the order.
The matter is set to be heard again on March 11, 2025, when the Court will review the progress made by the State in implementing these directives.
The Court highlighted, “Research and experience have shown that these plastic products have some very adverse impact on the eco-system and environment. Plastic waste cannot be easily recycled or safely destroyed. It causes waste management problems. It also affects the ecological balance and environment. Since plastic has a very long natural life, the dumping of plastic waste in public places, in water-bodies and elsewhere chokes the water-bodies, the drainage system and results in accumulation of garbage in public places,”
