Right To Live With Dignity Necessarily Entails To Act As Good Husband As Per Marital Vows Taken During Saptapadi Ceremony: Rajasthan HC

The Rajasthan High Court observed that the right to live with dignity enshrined under Article 21 of the Constitution necessarily entails acting as a good husband in terms of the marital vows taken during the saptapadi ceremony as per Hindu rituals.

The Court was hearing a Criminal Petition filed by the Petitioner seeking his interim bail for 3 months on medical grounds of his wife.

The bench of Justice Arun Monga observed, “Fundamental right enshrined under Article 21 of the Constitution of India, 1950, also encompasses right to live with dignity as a human being which necessarily entails to act as a good husband in terms of the marital wows taken during the saptapadi ceremony as per Hindu rituals.”

Advocate Priyanka Borana appeared for the Appellant and PP Vikram Rajpurohit appeared for the Respondent.

In the present case, the Petitioner was under judicial custody for more than two years. He was accused/under trial in multiple FIRs lodged against him for the offences under Sections 406, 420, 409, 467, 468, 471 and 120-B of IPC and also under Section 65 of I.T. Act, 2000.

The Court noted that the wife was getting medical treatment at Jawahar Lal Nehru Hospital, Ajmer, in the Neuro Surgery Department.

The Court also noted that the Petitioner was a person with family ties and was not a flight risk.

The Court granted temporary bail.

Accordingly, the Court allowed the Writ Petition.
