Delhi HC Issues Summons To Tata SIA (Vistara) Airlines In Suit For 2.7 Crore Damages Alleging Injuries To Minor Child Due To Crew's Negligence

The Delhi High Court summoned Tata SIA Airlines Ltd following a plea filed by the parents of a minor who sought damages of nearly Rs. 2.7 crore

The parents of the minor alleged that their child sustained injuries caused by acts of negligence and omission by the Airline’s crew. As per the plea, the child suffered after a hot beverage was spilt on her by a flight attendant. 

The Bench of Justice Anup Jairam Bhambhani directed the Airline to submit its response to the lawsuit within a month and to address the interim relief application within two weeks, scheduling the next hearing for March 6, 2024.

A suit was filed by the plaintiffs against Tata SIA Airlines Ltd., seeking damages of Rs. 2,68,93,077 for bodily injuries sustained during a flight from Delhi to Frankfurt on August 11, 2023. The injuries were allegedly caused by acts of negligence and omission by the defendant's crew.

Additionally, an I.A. was filed seeking ad-interim relief against the defendant. The court issued notice and directed the plaintiffs to take the requisite steps within 10 days.

Furthermore, another I.A. was filed for leave to sue the defendant for additional relief at a later stage. The Court issued a notice, and the plaintiffs are required to take the requisite steps within 10 days. The application's completion of pleadings is scheduled for March 21, 2024.

The Court, upon prima facie examination, registered the plaint as a suit and issued a summons to the defendant. The defendant was required to file a written statement within 30 days, and further proceedings were scheduled for March 21, 2024.

Accordingly, the Court listed one IA for March 6 2024 and another IA for March 21, 2024.
