No Error Apparent On The Face Of The Record: Apex Court Dismisses Review Petitions Against Article 370 Verdict

The Supreme Court has recently dismissed the Review Petitions filed seeking correction of the judgment, which unanimously upheld the abrogation of Article 370 of the Constitution of India, which had bestowed special status on the erstwhile state of Jammu and Kashmir.

On May 1, the 5-Judge Bench of Chief Justice DY Chandrachud, Justice Sanjiv Khanna, Justice BR Gavai, Justice Surya Kant, and Justice AS Bopanna dismissed the Petitions in the chamber.

The Constitutional Bench said, "Having perused the review petitions, there is no error apparent on the face of the record. No case for review under Order XLVII Rule 1 of the Supreme Court Rules 2013. The review petitions are, therefore, dismissed." Accordingly, the Court disposed of pending Applications, if any. 

On December 11, 2023, a Constitution Bench had held that Article 370, a temporary provision, was a feature of asymmetric federalism and not sovereignty. The Court had disposed of the batch of petitions challenging the Centre's decision. The 5-Judge Bench had pronounced an unanimous verdict upholding the abrogation. In delivering a total of three judgments, the Court, with a 5:0 majority, affirmed the legality of the decision.
