Supreme Court Grants Interim Bail To Law Student For Appearing In Exams

The Supreme Court on Thursday granted interim bail to a law student to take the examination, which is scheduled from July 24 2023 to August 7, 2023. The Special Leave Petition (SLP) challenged an impugned order of the Chhattisgarh High Court wherein the student along with the main accused and others were denied bail considering the trial was yet to commence. The matter was listed before the bench after the Chief Justice of India permitted the matter to be taken up upon mentioning.

The student in the matter allegedly while staging a protest had forcefully opened the main gate of the Bilaspur Police Station while dashing the police authorities and their employees.

A bench of Justice Sanjay Kishan Kaul and Justice Sudhanshu Dhulia while hearing the case issued a notice returnable in four weeks.

Advocate Manoj Selvaraj S. appeared for the petitioner.

In the pertinent matter, the petitioner-student was alleged to be part of a gathering near the police station protesting and seeking non-registration of the case against the accused Shiv Kumar Singh and others under Sections 147, 148, 294, 323, 506, 325, and 307 of the IPC.

As a consequence of the conduct of the petitioner, an FIR was registered against him under Sections 147, 341, 332, and 353, IPC, and the petitioner among others was arrested.

The petitioner being a law student and since he was scheduled to take the semester exam, he was granted an interim bail from April 6, 2023 to April 25, 2023.

However, the bail application filed by the petitioner and other such persons was rejected by the High Court through an impugned order dated May 15, 2023.

A bench of Justice Sanjay S. Agrawal of the Chhattisgarh High Court in the impugned order had observed, “Having considered the aforesaid contention of the parties, considering further the manner, in which the applicants have forcefully opened the main gate of the police station while dashing the police authorities and their employees, I am, therefore, not inclined to enlarge the applicants on bail, particularly when the trial of the matter is yet to be commenced”.
