Luxury Litigation At The Cost Of Employees Union's Fund Must Be Dealt With Iron Hands: SC In A Transfer Petition

The Supreme Court on Wednesday came down heavily on parties who approached the Apex Court for the transfer of a criminal case, of the many cases filed against each other.

A Bench comprising Justice Surya Kant and Justice J.K. Maheshwari observed prima facie that parties are abusing the process of law. The Court said that such luxury litigation at the cost of funds of the employees union of the Insurance company must be dealt with iron hands.

"[It] appears prima facie that the petitioner as well as respondent No.1 both are abusing the process of law by initiating multiple cases against each other at the cost of funds of the employees union of the Insurance Company. It further appears that the entire cost of litigation is also being siphoned from the funds of the Union. This kind of luxury litigation, which is at the cost of genuine and bona fide litigants, who are in queue before the Courts, must be dealt with iron hands", the Supreme Court said.

However, the counsel for the parties has sought time from the Court to take instructions for the withdrawal of respective cases filed by their clients.

The Court posted the matter for further hearing after four weeks and observed that needful be done in the meantime.
