Supreme Court Asks For Center's Counter Affidavit On Ashwini Upadhyay's PIL Against Illegal Immigrants

Ashwini Kumar Upadhyay today mentioned a PIL regarding illegal immigrants living in different parts of the country, filed in the year 2017.

He mentioned before the Bench of Chief Justice N V Ramana.  "5 crore illegal immigrants are using our resources", submitted Ashwini Upadhyay.

Chief Justice remarked that "These are definitely important issues. However, Courts have a limited role. The elected representatives have to look into it."

Ashwini Upadhyay said that Article 32 jurisdiction is to be used for such purposes. His plea seeks detection, detention and deportation of illegal immigrants. He also submitted before that Court that crores of jobs are being taken by the illegal immigrants and that the right to livelihood of citizens is hampered.

The Chief Justice then remarked that these are political issues and that he should take it up with the government. 

Solicitor General Tushar Mehta who was present during the mentioning said that he was not aware of the matter. 

The Court said that the matter can be listed once the centre files its counter affidavit.
