Supreme Court Collegium Recommends Names Of Two Advocates To Be Judges Of Chhattisgarh High Courts

The Supreme Court collegium consisting of Chief Justice of India D.Y. Chandrachud, Justice Sanjiv Khanna and Justice B.R. Gavai, resolved to recommend the names of two advocates for appointment as judges of the Chhattisgarh High Court. The two recommended candidates are Advocates Bibhu Datta Guru and Amitendra Kishore Prasad.

The recommendation follows a previous endorsement from the Chief Justice of the Chhattisgarh High Court, who, along with his two senior-most colleagues, had proposed the names for judicial elevation on February 21. The collegium noted that both the Chief Minister and the Governor of Chhattisgarh have approved these recommendations.

In accordance with the Memorandum of Procedure, the collegium sought the opinion of a Supreme Court judge familiar with the Chhattisgarh High Court’s affairs to evaluate the candidates' suitability. However, this judge recused himself from providing feedback because one of the candidates is related to him.

The collegium thoroughly reviewed and assessed the available records, including observations from the Department of Justice and any complaints related to the candidates. The resolution released on the Supreme Court's website outlined that, after this scrutiny, the collegium found no adverse information concerning the integrity of either candidate.

For Bibhu Datta Guru, the Department of Justice’s inputs revealed no negative aspects concerning his integrity. Guru’s legal expertise is evidenced by his involvement in 54 reported judgments from the High Court. Considering his experience, age, and standing at the Bar, the collegium concluded that Guru is well-suited for appointment as a High Court judge.

Similarly, for Amitendra Kishore Prasad, the Department of Justice’s report highlighted his strong personal and professional reputation with no integrity issues. Prasad has appeared in 110 reported judgments, demonstrating his extensive legal practice. Given his qualifications, experience, and Bar standing, the collegium also determined that Prasad is fit for judicial appointment to the High Court.

The notification dated July 30, 2024 read, “In view of the above, the Collegium resolves to recommend that S/Shri (i) Bibhu Datta Guru, and (ii) Amitendra Kishore Prasad @ A K Prasad, Advocates, be appointed as Judges of the High Court of Chhattisgarh. Their inter se seniority be fixed as per the existing practice.
