Allahabad HC Dismisses Plea Seeking Killing Of Birds & Animals Causing Nuisance

The Allahabad High Court has dismissed a plea seeking culling of birds and animals causing nuisance or vermin.

The bench of Justice Ramesh Sinha and Justice Subhash Vidyarthi was dealing with a plea filed by an Advocate Manoj Kumar Dubey who had sought directions to the Nagar Nigam, Lucknow to discharge the duty of destructing the birds or animals causing nuisance or vermin.

The plea had also sought killing of stray or owner less dogs in the city of Lucknow.

Sudeep Seth, Senior Advocate assisted by Counsel Sridhar Awasthi, appeared for the petitioner whereas V.P. Nag Standing Counsel appeared on behalf of the State and Advocate Namit Sharma appeared for the Nagar Nigam.

The Court observed that such a direction cannot be issued by the Court as there is no provision which obliges the Nagar Nigam to kill innocent animals.

“The instant petition has been filed in the nature of public interest seeking issuance of a direction to the Nagar Nigam, Lucknow to discharge the duty of destructing the birds or animals causing nuisance or vermin and destructing the stray or owner less dogs in the city of Lucknow.

Such a direction cannot be issued by the Court as there is no provision which obliges the Nagar Nigam to kill innocent animals.”, the bench held.

Thus the Court dismissed the petition.

“In view of above, the writ petition lacks merit and it is accordingly dismissed.”, the Court held.
