Allahabad HC Slams District Administration Over Allegation Of Demolishing House Of A Lawyer Without Notice

The Allahabad High Court has pulled up the District Administration over its alleged act of demolishing the house of a lawyer without issuing a notice.

"…the alleged action of demolition, that is too, without notice to the house owner speak volumes about the action on the part of the Administration.", the Court observed.

The bench of Justice Devendra Kumar Upadhyaya and Justice Saurabh Srivastava has directed the parties to maintain status quo in the matter.

Advocate Amrendra Nath Tripathi appeared for the petitioner.

A Public Interest Litigation was filed by the District Bar Association, Amethi wherein various allegations of accesses against the members of the Bar Association, allegedly committed by the District Administration have been mentioned.

One incident on which emphasis has been laid by the counsel for the petitioner relates to a land that was given to the General Secretary of District Bar Association, Amethi.

It has been stated that once the exchange of the land took place statutorily and that too, under the order passed by the court concerned, the said General Secretary came in possession over the said land and constructed a house and its boundaries.

The Court noticed a letter annexed to the petition wherein it has been stated that exchange of land by means of the above order was wrongly made.

It is the assertion of the counsel for the petitioner that after cancelling the said order immediately the house has been demolished using heavy machinery.

The Court observed that the alleged action of demolition without notice to the house owner speak volumes about the action on the part of the Administration.

The Court directed the Chief Standing Counsel to place all facts before the Court.

"We also expect that members of the Bar Association shall not be subjected to unnecessary harassment.", the Court added further.
