It Appears That 'Kalyug' Has Arrived: Allahabad High Court On Dispute Of Maintenance Between Elderly Couple
|The Allahabad High Court while dealing with a dispute of maintenance between an elderly couple remarked that, it appears that 'Kalyug' has arrived.
The Court was hearing an application filed by a 80-year-old man, challenging an order of maintenance directing him to pay Rs. 5,000/- per month to his wife.
A Single Bench of Justice Saurabh Shyam Shamshery said, "It appears that Kalyug has arrived since a couple of aged about 75-80 years is fighting a legal battle against each other for maintenance."
Advocate G.S.D. Mishra appeared on behalf of the applicant (husband).
In this case, the dispute began when the applicant's wife sought financial support from her husband in the Family Court. She had alleged that her husband was getting Rs. 35,000/- per month as pension.
The Family Court awarded the wife with a maintenance of Rs. 5,000/- per month being aggrieved by which the husband was before the High Court.
The Court in the above regard noted, "Dr. G.S.D. Mishra, learned counsel for applicant (husband), has raised various arguments, which are necessitated to issue notice to Opposite Party No. 2 (wife)."
The Court ordered that the steps be taken within one week.
"In addition to normal mode of service, Dasti service is also permitted", it added.
Accordingly, the High Court issued a notice to the wife, saying that it hopes that the parties may come with a settlement.
