Bombay High Court Grants One-Week Temporary Bail To Murder Convict For LLB Entrance Exam
|The Bombay High Court granted a week's temporary bail to a murder convict serving a life sentence, allowing him to appear for the LLB entrance exam.
The Court was hearing an appeal against the impugned order that convicted the applicant for the offence punishable under Section 302 of the IPC and sentenced him to suffer imprisonment for life.
The bench of Justice N R Borkar and Justice Somasekhar Sundaresan observed, “ Considering the said facts, we are inclined to release the Applicant on temporary bail for a period of one week.”
The Court permitted the Counsel for the Applicant to circulate the Interim Application under Section 389 of the Criminal Procedure Code because the Applicant wants to appear for the LLB-CET examination.
The Court also noted that the applicant has produced on record the admit card and sought temporary bail for one week to enable him to appear for the said examination.
The Court noted that the Applicant was in jail for about nine years. It further noted that during trial he was on bail for some period and he did not misuse the liberty granted to him.
Accordingly, the Court directed that the bail be furnished before the trial Court.
