Classrooms Of Sealed Rampur Public School Will Be Opened During Internal Exams: State Govt Informs Allahabad HC

The State Government has informed the Allahabad High Court that the classrooms of the sealed Rampur Public School will be opened during the course of conduct of the internal examinations from 6 a.m. to 3 p.m. on March 17 and 18.

The said school was earlier sealed by the district administration because its premises was not cleared despite the cancellation of the lease.

A Division Bench of Justice Surya Prakash Kesarwani and Justice Anish Kumar Gupta noted, “Shri Ajit Kumar Singh, learned Additional Advocate General states on instructions that class rooms required for internal examination of students on 17.03.2023 and 18.03.2023 shall be opened and no interference in the class rooms shall be caused by the State-respondents during the course of conduct of the examination i.e., from 6 A.M. to 3 P.M. on both days.”

The Bench directed the district administration to abide by the statement made by the counsel for the State.

Senior Advocate Shashi Nandan represented the petitioner while AAG Ajit Kumar Singh represented the respondents.

In this case, a petition was filed by the Executive Committee of Jauhar Trust seeking the completion of the internal exams of the students studying in a school. The government building of the Jauhar research institute was given to Khan's Jauhar Trust on a Rs 100 yearly lease for 99 years by the Samajwadi Party regime.

A senior district administration official said that the notices were served to the manager of the said Trust several times asking them to vacate the school and when the school building was not vacated, the administration sealed the entire premises including the school.

The High Court in view of the above observed, “Learned Additional Advocate General states that the learned Advocate General shall argue this case, who is not available today and, therefore, the matter may be taken up on Tuesday i.e., 21.03.2023.”

The counsel for the petitioner submitted before the Court that he is not opposing the adjournment but the difficulty is that the internal examination of students of the institution from Class 1 to 9 and Class 11 are going on, which shall conclude on March 18 and, therefore, till the examination is concluded, no interference may be made.

“In view of fair stand taken by the learned Additional Advocate General, no further order is required to be passed at this stage. We direct that the State-respondents shall abide by the statement made by the learned Additional Advocate General, as aforenoted”, directed the Court.

Accordingly, the Court listed the matter for hearing on March 21.
