High Court Allows Farmers Association To File Application Afresh Seeking Police's Permission To Hold Demonstration At Jantar Mantar

The Delhi High Court allowed the President of the National South Indian Rivers Interlinking Farmers Association (Farmers Association) to file afresh consideration before the City Police.

The Court dismissed a Petition seeking permission to file afresh consideration for a peaceful demonstration demanding the release of Cauvery water from Karnataka to Tamil Nadu. The Petitioner had previously filed a representation before the Deputy Commissioner of Police (DCP), which was dismissed without recording any reasons.

The Bench headed by Chief Justice Satish Chandra Sharma and comprising Justice Sanjeev Narula observed, “The afore-extracted order, though addressed to Petitioner, has not been enclosed with the petition. Nonetheless, Mr. Tripathi has stated that Petitioner is free to submit a fresh representation with all relevant details, keeping in view S.O. No. L&O/48/2022, and in case the same is preferred, it shall be dealt with in accordance with extant rules”.

Advocate Santosh Kr. Tripathi appeared on behalf of the Respondent.

The Respondent argued that the Farmers Association's application was rejected based on the guidelines outlined in the Standing Order dated April 28, 2023. Further, it was also contended that the guidelines cover the organization of protests or demonstrations in Central Vista, including Jantar Mantar or Boat Club areas. Additionally, the Respondents said that when considering a request, various factors, including time restrictions, must be examined. Although the Respondent submitted before the Court that the Petitioner can submit another application for afresh consideration.

After considering the relevant contentions of the parties, the Court granted the Petitioner permission to file afresh an application with all relevant details.

Accordingly, the Court disposed of the Petition.
