HC Directs Delhi Govt To Reimburse Tuition Fee To Student As Per Post Matric Scholarship Scheme

The Delhi High Court recently directed the Delhi Government to proceed with the processing of the reimbursement of the tuition fee paid by a Student under the Post Matric Scholarship Scheme.

The bench of Justice Prathiba M. Singh was dealing with a plea filed by a Class 12 student seeking directions to disburse the amount of Rs. 44,100 to him towards ‘non-refundable fees’ already paid by him.

He sought reimbursement of the tuition fee paid by him as per the Post Matric Scholarship for students belonging to Scheduled Castes in India which is a scheme launched by the Government of Delhi.

In this case, due to an error made by the school, the tuition fee of Rs.44,100/- paid by the Petitioner was not filled up by the school in the online form for reimbursement and hence the same was not reimbursed.

The Counsel for the Petitioner submitted that the Scheme by the Union of India contemplates issuance of free-ship cards to the students so as to non-cause inconvenience to them in receiving the scholarship amounts. The Delhi Government however, in its implementation follows the scheme of reimbursement of tuition fee amount instead of issuing free-ship card.

Advocate Rahul Sagar Sahay appeared for the petitioner-student whereas Advocate Ashish Jain appeared for Union of India and Advocate Santosh Kumar Tripathi for Delhi Government.

The Court issued notice to Delhi Government and Centre. The Court directed issuance of a separate notice to the school to file its response.

The Court directed the Delhi Government to proceed with the processing of the reimbursement of the tuition fee, if it's satisfied with the credentials and documents of the Petitioner.

“In the meantime, on the strength of this writ petition, if the GNCTD is satisfied with credentials and documents of the Petitioner, it may proceed with the processing of the reimbursement of the tuition fee which has been deposited by the Petitioner, in terms of the scheme.”, the Court directed.
