Karnataka High Court Grants 30 Days Parole To Life Convict In Murder Case On Wife’s Plea For Begetting Progeny

The Karnataka High Court has granted 30 day parole to a life convict after his wife cited deprivation of her right to progeny.

The bench of Justice S.R. Krishna Kumar was hearing a Writ Petition seeking a direction by issuance of a Writ in the nature of mandamus to respondent- Chief Superintendent of Central Prison to consider her request for grant of general parole for a period of 90 days to her husband, who is a life convict.

Brief Facts-

The petitioner Neetha G.’s husband was convicted of crimes including Sections 302, 201 r/w. Section 34 of the IPC and sentenced to life imprisonment. After serving five years and one month, he was granted a 15-day parole during which the petitioner married him. Now, she seeks his further parole, citing her desire of having children.

The Court noted that the husband of the petitioner has already availed parole for a period of 15 days previously on the application made by his mother and now his wife seeks parole only on the ground that she is deprived of her right of progeny.

The Court deemed it appropriate to grant the husband of the petitioner general parole for a period of 30 days.

Consequently, the Court allowed the Writ Petition partly.
