Kerala HC Grants Anticipatory Bail To Man Accused Of Displaying 'Highly Poisonous Cobra' While Delivering Speech At Medical College
|The Kerala High Court has granted anticipatory bail to Vava Suresh, a famous snake catcher in the state, accused of displaying a highly poisonous cobra next to the mike while delivering speech at Government Medical College Kozhikode.
The bench of Justice Viju Abraham observed that custodial interrogation of the accused may not be required for the purpose of investigation and only a limited custody be granted for the said purpose.
The bail applicant was accused of commission of offences punishable under Sections 2, 9, 40 and 51 of the Wild Life Protection Act.
The prosecution had alleged that the accused had displayed a highly poisonous cobra next to the mike while delivering his speech, while attending an event organized at Government Medical College Kozhikode.
Advocate M.R. Sarin appeared for the accused whereas Public Prosecutor Nagaraj Narayanan appeared for the State.
"Having regard to the facts and circumstances of the case and considering the nature of the allegations, I am of the opinion that custodial interrogation of the petitioner may not be required for the purpose of investigation and only a limited custody be granted for the said purpose.", the Court observed while granting bail.
The Court has directed him to surrender before the investigating officer on January 2023, at 11a.m, and subject himself for interrogation on that day and on any other day/days as directed by the investigating officer.
The Court further directed him to cooperate with the investigation.
The Court directed that the petitioner shall not attempt to contact the defacto complainant or interfere with the investigation or to influence or intimidate witness.
The Court ordered that if any of the aforesaid conditions are violated, the investigating officer of Thamarassery Forest Range Office, Kozhikode may file an application for cancellation of bail.
