Breaking: Supreme Court Stays Proceedings Against Shahnawaz Hussain On Allegation Of Rape

Breaking: Supreme Court Stays Proceedings Against Shahnawaz Hussain On Allegation Of Rape

The Supreme Court has stayed all further proceedings against BJP leader Shahnawaz Hussain in the rape case against him, as also the Delhi High Court's order directing the registration of an FIR against him. The Court also said in the order that the complainant has claimed that she was assaulted and directed police to grant her protection ifshe approaches police seeking protection.

The Bench comprising of Justice U. U. Lalit, Justice S. Ravindra Bhat and Justice Sudhanshu Dhulia said that after hearing Senior Advocates Mukul Rohatgi and Sidharth Luthra it is of the prima facie view that the matter requires consideration.

The Advocate Sanjeev Kumar Singh appearing for the prosecutrix said that there is a threat to her life.

BJP leader had on Thursday mentioned his plea before the Supreme Court challenging the order of the Delhi High Court directing registration of FIR in the matter of allegation of rape against him and that investigation be completed and a detailed report be filed.

Hussian has contended in his appeal that the complainant had earlier tried to falsely implicate him in the marital disputes with his brother Shahbaz Hussain, but failed to get an FIR registered. He has also contended that the High Court's direction to register the FIR was without considering the reply filed by Police Authorities, which he claims exonerates him.

A complaint was filed against him in 2018 alleging the commission of offences under Section 376 (Rape), 120B (Criminal Conspiracy) and 506 (Criminal Intimidation) of the Indian Penal Code. The Delhi High Court had dismissed the petition filed by the BJP leader challenging the order of the Special Judge who had dismissed a revision petition filed against the order of the Metropolitan Magistrate directing registration of FIR in the matter.
