Breaking: SC Orders Status Quo On Demolition Drive By NDMC On Mentioning While Delhi HC Refuses Relief On Mentioning
|The Supreme Court had ordered status quo on the demolition drive being carried out by the North Delhi Municipal Corporation (NDMC) in the area.
The matter was mentioned before the Bench of Cheif Justice N. V. Ramana, Justice Hima Kohli and Justice Krishna Murari by Senior Advocate Dushyant Dave and Senior Advocate Kapil Sibal.
Dushyant Dave told the Bench that the demolition drive has been started at 9 am in the morning instead of 2 pm fixed earlier, anticipating mentioning before the Court.
The Court directed that status quo be maintained and directed that the matter be listed before an appropriate bench tomorrow.
Kapil Sibal mentioned the plea by the Jamiat Ulama-I-Hind, stating that it has all India ramifications and requested that it be also listed tomorrow. The Court agreed.
In the mean while, the NDMC demolition was also mentioned before the Delhi High Court. The Additional Solicitor General Chetan Sharma pointed out before the Delhi High Court that the matter is also being mentioned before the Supreme Court.
Advocate Shahrukh Alam pleaded for an interim stay on the demolition proceedings, at least till 2 pm, citing that many residents are not at their homes on account of the violence. He also told the Bench that the plea before the Supreme Court is a general plea regarding demolitions and that his is a specific plea regarding the NDMC demolition drive.
The Bench of Acting Chief Justice Vipin Sanghi and Justice Navin Chawla directed that the matter be listed today and that the ASG should be ready with instructions.
The Court, however, did not pass any interim order upon mentioning.
