“I’ll Take A Call On It”- CJI DY Chandrachud On Listing Of Petitions Challenging Abrogation Of Article 370
|The Supreme Court today said that it will take a call on the listing of pleas challenging the abrogation of Article 370.
“I’ll take a call on it”, said the Bench led by Chief Justice DY Chandrachud and comprising Justice PS Narasimha and Justice JB Pardiwala.
Senior Advocate Raju Ramachandran mentioned before the Court for urgent listing of the bunch of pleas challenging the abrogation of Article 370 of the Constitution which conferred special status on Jammu and Kashmir.
Several petitions challenging the Centre's decision to abrogate Article 370 and the enactment of the Jammu and Kashmir Reorganisation Act, 2019, which splits J-K into two Union Territories, Jammu and Kashmir, and Ladakh, were referred to a Constitution Bench headed by Justice N V Ramana in 2019, by the then CJI Ranjan Gogoi.
On August 5, 2019, two Constitution Orders were issued by the President in the exercise of his power under Article 370 and these Constitution Orders made the Constitution of India applicable to the State of Jammu and Kashmir in its entirety, like other States in India.
In March 2020, a 5-Judge Constitution Bench led by then CJI NV Ramana denied referring the batch of petitions to a larger Bench.
