SC Collegium Recommends Transfer Of 2 Judges Of Different High Courts, Rejects 1 HC Judge's Request Against Transfer
|The Supreme Court Collegium has recommended the transfer of three Judges of High Courts.
The details are as follows-
• The Collegium has proposed to transfer Justice V M Velumani, Judge of the Madras High Court, to the Calcutta High Court.
• The Collegium has proposed to transfer Justice Sanjeev Prakash Sharma, Judge of Patna High Court, to the High Court of Punjab and Haryana.
• The Collegium has proposed to transfer Justice Atul Sreedharan, Judge of the Madhya Pradesh High Court, to the High Court of Jammu & Kashmir and Ladakh.
Justice V M Velumani
The Collegium by its resolution dated September 29, 2022, proposed to transfer Justice V M Velumani to the Calcutta High Court. Justice V M Velumani sought a transfer to a High Court of the North-eastern States, preferably Manipur or Tripura, on the ground that she would then be able to retain her official accommodation at Chennai.
The Collegium rejected her request for transfer to either Manipur or Tripura or any High Court in the North-eastern States.
“The request made by Ms Justice V M Velumani to retain her at the Madras High Court has been rejected by the Collegium on an earlier occasion. There is no valid reason to reconsider the earlier decision of the Collegium by which her transfer has been recommended to the Calcutta High Court or to accede to her fresh request.”, the Collegium statement read.
Justice Sanjeev Prakash Sharma
Justice Sanjeev Prakash Sharma was appointed as a Judge of the Rajasthan High Court in 2016. He was transferred to the High Court of Judicature at Patna. He sought repatriation to the Rajasthan High Court on the ground, inter alia, of his poor health and unavailability of adequate medical facilities at Patna.
The Collegium has resolved to transfer Justice Sanjeev Prakash Sharma to the High Court of Punjab and Haryana.
Justice Atul Sreedharan
Justice Atul Sreedharan sought a transfer out of the State of Madhya Pradesh on the ground that his elder daughter would enter practice next year and would be appearing before the District Court and the Indore Bench of the High Court. The Collegium accepted the request of Justice Atul Sreedharan and resolved to transfer him to the High Court of Jammu & Kashmir and Ladakh.
