'Will Not Address Electronic Media Or Social Media': SC Imposes Condition On Jitendra Tyagi While Granting Bail In Dharma Sansad Hate Speech Case
|The Supreme Court has granted post-arrest bail to Jitender Narayan Tyagi in Dharma Sansad hate speech case while imposing the condition that he will not address electronic media or social media.
"…in addition, to the terms and conditions imposed by the trial Court for ensuring his presence and participation in the trial, that he will not address electronic media or social media and shall not indulge into such alleged activities any more, directly or indirectly.", the Bench of Justice Ajay Rastogi and Justice B.V. Nagarathna observed.
The petition seeking post-arrest bail was filed by Jitender Narayan Tyagi alias Vasim Rizvi in relation to the alleged incident of hate speech against minorities in Dharam Sansad that happened in Haridwar, Uttarakhand. The Uttarakhand police had booked Rizvi under Sections 153A and 298 of the Indian Penal Code.
Senior Advocate Siddharth Luthra appeared for the petitioner whereas Advocate Mehmood Pracha appeared for the Respondents.
"After we have heard the learned Counsel for the parties and taking into consideration the matter in totality, without going into the merits/demerits of the case, this Court is of the view that the petitioner has made out a case for grant of post-arrest bail…", the Court observed before imposing bail conditions.
The Court directed that the petitioner be produced before the Trial Court within three days and shall be released on post-arrest bail subject to such terms and conditions to the satisfaction of the concerned Trial Court.
"The petitioner may be produced before the Trial Court within three days and shall be released on post-arrest bail subject to such terms and conditions to the satisfaction of the concerned trial Court and on furnishing undertaking in above terms before the trial Court.", the Court directed.
The Court also added that "If the petitioner violates or commits breach of any of the conditions on which bail has been granted to him, the respondents/prosecution is at liberty to move an application seeking cancellation of bail."
