ASI Stopping Namaz In Mughal Mosque- SC Dismisses SLP Against HC's Order Refusing To Advance Hearing Of Plea

The Supreme Court has rejected an SLP (Special Leave Petition) that challenged the order passed by the Delhi High Court by which it refused to advance the hearing of a plea filed by the Managing Committee of Delhi Waqf Board against the ASI (Archaeological Society of India) stopping namaz at the mosque in a city.

The two-Judge Bench comprising Justice Krishna Murari and Justice C.T. Ravikumar observed, “We do not find any good ground to interfere in the matter which is already pending before the High Court. Accordingly, the Special Leave Petition is dismissed. However looking in the facts and circumstances of the case, we request the High Court to take up the pending matter in W.P.(C) No. 10596/2022 and decide the same in accordance with law on its own merits as expeditiously as possible.”

Advocate M Sufian Siddiqui appeared on behalf of the petitioner in this matter while no one appeared on behalf of the respondents.

In this case, the petitioner challenged the order of the Delhi High Court passed on March 7, 2023. The grievance of the petitioner was that the officials of the ASI have completely stopped namaz in the Mughal Mosque since May 13 last year in an unlawful, arbitrary, and precipitous manner, without serving any notice or order.

The Apex Court after hearing the arguments of the counsel disposed of the petition.
