Supreme Court Grants Interim Bail To Azam Khan Till His Regular Bail Application Is Decided By Trial Court

The Supreme Court Bench comprising of Justice L. Nageswara Rao, Justice B. R. Gavai and Justice A. S. Bopanna today directed release of Azam Khan on interim bail in a case registered at Rampur, UP, with respect to alleged deficiency in the registration process of a school being run by a trust.

The Supreme Court, using the inherent under Article 142 of the Constitution, released Azam Khan on interim bail. The Bench also allowed him to apply for regular bail within a period of two weeks before the appropriate local court.

The interim bail granted would be available till such time that the regular bail application is adjudicated upon.

The Supreme Court had on 17th May reserved its order on the interim bail plea by the Samajwadi Party leader who has been under Judicial Custody. The Bench had earlier expressed displeasure with the delay in pronouncement of judgment by the Allahabad High Court in his bail application. Azam Khan had been in jail in Sitapur from February 2020 for 89 FIRs registered against him.

On the last date of hearing it was submitted by the Additional Solicitor General S. V. Raju appearing for the State of Uttar Pradesh that Khan had threatened the Investigating Officer while his statements were being recorded. It was also submitted by him that Khan is a Habitual Offender
