Supreme Court Directs UPSC To Issue Mains Examination Admit Card For 8 Aspirants Under EWS Quota
|The Supreme Court in two Writ Petitions, while granting relief to 8 UPSC aspirants, has directed the Union Public Services Commission to issue admit cards for Mains examination to aspirants availing benefit under Economically Weaker Section (EWS) Quota. The bench, however, denied relief to 3 aspirants, as even otherwise, they would not qualify for the examination.
In this cas, the issues essentially were with regard to the non-submission of provisional certificates and validity of the EWS Certificate, wherein highlighting certain minor errors the Commission had rejected the candidature of the petitioners for appearing in Civil Services (Main) Examination, scheduled on September 15, 2023.
A bench of Justice A.S. Bopanna and Justice Prashant Kumar Mishra while directing the respondents to issue admission tickets, further clarified it shall remain subject to the final result of the petition.
Advocate Gaurav Agrawal appeared for the petitioners.
At the outset, the bench in the matter noted for the petitioner Nos. 1 and 2, the result of the under graduate examination has been declared at the present stage.
Therefore, the question to be adjudicated upon subsequently, is whether they would be qualified or not.
Considering, the above factual matrix, the bench observed, “…that the Civil Services (Main) Examination is scheduled to be held on 15.09.2023 and the interest of the petitioners would be affected if they are not permitted to appear in the said Examination. Hence, making it subject to the final result of this petition and also with a condition that the petitioners shall not claim equity in the matter, we direct the respondents Nos. 1 to 3 to permit the petitioners Nos. 1 & 2 to appear in the said examination by issuing admission tickets which shall however remain subject to the final result of this petition”.
The bench however, denied relief to two other petitioners as it was not satisfied that the minimum required qualification is available even as of now. “This order shall not ensure to their benefit”, the bench further noted in the matter.
Accordingly, the bench issued notice in the both the petitions.
