SCAORA Vehemently Opposes Supreme Court's Decision To Discontinue Practice Of Circulating Adjournment Slips Till December 15

The Supreme Court has halted the practice of circulating advance adjournment slips by advocates with immediate effect till December 15, 2023, in order to accommodate the listing of a maximum number of cases before winter break.

The move has been taken to promote the interest of aggrieved litigants who approach the court.

Pertinently, the Supreme Court Advocates-On-Record Association (SCAORA) has vehemently opposed the implementation of the circular. As per the resolution passed by the Executive Committee of SCAORA late evening yesterday, the absence of prior notice before issuing the circular would result in an unfair burden on lawyers for an unprepared matter “especially in view of the present sudden and faulty listing of matters by the Registry”.

“In order to accommodate the request of listing maximum number of cases in the interest of litigants and in view of the ensuing winter vacation, all stakeholders to note that the practice of circulating adjournment slips/letters is discontinued with immediate effect till 15.12.2023”, the circular issued on December 5, 2023 read.

However, the circular also clarified that in case of any genuine difficulty, a request for adjournment can be made before the Court concerned.

“The Supreme Court Advocates-On-Record Association (SCAORA) resolves to vehemently oppose the implementation of the aforesaid circular which discontinues the well-established practice of circulating letters in the bests interests of the litigants and for the convenience of the Hon’ble judges”, the resolution passed in response read.

Consequentially, SCAORA through the resolution requested the Chief Justice of India D.Y. Chandrachud to expedite the reversal of the circular.
