The Kerala High Court directed the Central Bureau of Investigation (CBI) to submit a detailed report of its probe into the mysterious death of two young sisters, who died within a span of two months at their huts in Walayar.

The Bench of Justice K. Babu, in an interim order, directed the CBI to place before it the details of the probe in a sealed cover. Advocate PV Jeevesh appeared for the petitioner.

Background of the Case

In the year 2017, two teenage girls were found hanging inside their hut under mysterious circumstances. The eldest of the siblings aged 13 was found hanging inside their hut on January 13, 2017, and her 9-year-old sister died in the same manner on March 4, 2017.

The police concluded that the two girls had died by suicide after they were sexually abused by five persons, including a juvenile, in an unnatural way for nearly one year.

In October 2019, the Protection of Children from Sexual Offences (POCSO) Court’s passed the order of acquittal on the ground of lack of evidence. Appeal was preferred against the acquittal order before the High Court.

The High Court allowed the appeal and remanded back the case for re-trial and observed that there were serious lapses in the investigation which resulted in a miscarriage of justice and the order passed by the POCSO Court was also set aside.

Thereafter, the government handed over the probe to the CBI. The CBI then submitted the chargesheet before the POCSO Court in December 2021, wherein it was stated that the girls had died by suicide after they were sexually assaulted.

In the Writ petition, it was alleged by the petitioner that from the beginning of the investigation, there were deliberate attempts on part of the CBI to sabotage the investigation and that they were abusing its powers of investigation.

Therefore, the mother preferred the petition and sought a court-monitored investigation.

Accordingly, the matter was listed for further hearing on February 20, 2023.
