Petitioner Suppressed That He Is Congress Spokesperson: MP High Court Dismisses PIL Seeking Inquiry In Mahakal Lok Incident
The Indore Bench of the Madhya Pradesh High Court has dismissed the PIL seeking an inquiry into Mahakal Lok Incident in which the religious idols were damaged and destroyed.
The PIL was filed by Krishna Kumar Mishra, spokesperson of the Congress Party demanding inquiry and action against the incident.
The Division Bench of Justice Sushrut Arvind Dharmadhikari and Justice Hirdesh said that “The question which arises for consideration in this Public Interest Litigation would be whether the same is maintainable in the light of noncompliance of Rules 13, 14, 15, 16 and 17 of Chapter XIII-A of the M.P. High Court Rules 2008. Moreover, the petitioner has also suppressed the fact that he is a spokesperson of the Congress Party M.P.”
Senior Advocate Ajay Bagadiya represented the Petitioner while Advocate General Prashant Singh represented the Respondents.
The PIL was filed to direct the Court to form an independent committee to enquire into the Mahakal Lok Incident. In the said incident, the religious idols of Saptrishi were fallen and destroyed and also the religious sculpture installed over the entry gate had fallen over the floor and damaged the floor tiles in the Mahakal Rudrasagar Integrated Development Area, Ujjain, hurting the religious feelings of the devotees of Bhagwan Shri Mahakaleshwar.
The Petitioner further alleged that he is a prominent social activist and thus has grounds to file this PIL. It was contended by the Respondent that the Petitioner failed to disclose the fact that he’s the spokesperson of Congress in Madhya Pradesh, and therefore, had a hidden agenda.
After a careful examination of facts and circumstances, the Court said “It is informed at the bar that the Lokayukt Madhya Pradesh has already initiated suo motu action against the culprits to inquire and to find out the irregularities etc. in construction of Mahakal Lok. In view of the non-compliance of the Rules of 2008 as well as the pendency of the inquiry report before the Lokayukt M.P., and the guidelines laid down in the case of Balwant Singh Chaufal this Court is not inclined to entertain this writ petition.”
Accordingly, the High Court dismissed the Petition.
