Fake Doctors Are Menace To Society; 'Medical Practitioners' With Diploma Under Indian System Of Medicine Practising Allopathy Is A Serious Issue: Madras HC
The Madras High Court observed that medical practitioners with a diploma certificate under the Indian System practising allopathy is a serious issue.
The Court said that fake doctors are a menace to society as they are playing with the lives of innocent people, who are coming to them believing that they are genuine Doctors.
The Court was hearing a Writ Petition challenging the order issued by the first respondent, seeking a directive for the first respondent to conduct an inquiry and take disciplinary action against the other respondents for alleged misconduct at Surya Nursing Home and AMK Medical Shop, and to refund the imposed fine of Rs.5,000/-.
The bench of Justice K. Murali Shankar observed, “Fake Doctors are menace to society. Some persons by calling themselves as Medical Practitioners with the help of Diploma certificate issued under various other Indian Systems of Medicine and practicing Allopathy system of Medicine is a serious issue and such pseudo doctors are playing with the life of innocent people, who are coming to them believing that they are genuine Doctors. The Government through the official respondents are duty bound to deal with such persons with iron hands.”

Brief Facts-
The Court directed the Respondents to consider the request of the Petitioner who was running a hospital and a medical shop, to refund the fine of ₹ 5000/-. that was collected for not obeying the guidelines issued by the Government of Tamil Nadu to control and prevent the spread of COVID-19. Respondents rejected the claim of the Petitioner hence, he approached the Court with the present Petition.
The Court noted that despite the report by the fifth respondent that there were omissions and commissions found in the petitioner's hospital and there were some persons giving Allopathy treatment to the patients without having necessary qualifications official respondents did not take any action.
The Court said that in the present case, the authorities after coming to know about the hospital being run by some fake persons, remained as mute spectators and got themselves satisfied with the imposition of a fine of Rs.5,000/-.
The Court directed the official respondents to ascertain whether the petitioner and other persons working in his Surya Nursing Home have required qualifications to practise the Allopathy system of Medicine and if not, to take appropriate action.
Finally, the Court dismissed the Writ Petition.
