The Patna High Court, while transferring the case of the missing girl to CBI, noted that CID itself is dependent on various other agencies and the Department of the Government.

The Court was hearing a Writ Application seeking the issuance of directions for transferring the Case to the Central Bureau of Investigation (CBI).

The bench of Justice Rajeev Ranjan Prasad observed, “…the CID seems to be in a position from where it may not be able to crack this case and the agency itself is dependent on various other agencies and the Department of the Government, therefore, there is some issue of coordination as well.”

Brief Facts-

The present Writ Application was filed by the father of a missing girl after his daughter left for college and has been untraceable since then. Despite the girl's maternal grandfather reporting that she was missing, an FIR was registered four days later under IPC Sections 363 and 365. The Petitioner claimed that the investigation stalled after the appointed officer went on leave, after which he wrote to the Director General of Police and the National Human Rights Commission. Although the NHRC responded and urged local authorities to act, six months have passed without any progress. Hence, the Petitioner sought judicial intervention.

The Court said that it could sense from the submissions on behalf of the CID that perhaps nothing more remains to be done at their end and they do not have further expectations to unearth the truth.

Accordingly, the Court directed that the investigation of the case be handed over to the Central Bureau of Investigation.

The Court listed the matter on October 18, 2024, for further hearing.
