Uttarakhand HC Issues Notice To BCI And State Bar Council On Plea Challenging Fee Hike For Filing Complaints Against Advocates
The Uttarakhand High Court has issued notice to the Bar Council of India and the Bar Council of Uttarakhand, seeking their response on a petition challenging the hike in the fee charges for filing disciplinary cases before the State Bar Council against advocates.
The bench also sought an explanation on how the Bar Council has proposed to further enhance to Rs.5,500/- from Rs.1,750/- for filing disciplinary cases.
A bench of Justice Vipin Sanghi and Justice Rakesh Thapliyal heard the matter.
"...The State Bar Counsel should file a short affidavit explaining as to how the fees for entertainment of disciplinary cases/complaints has been enhanced from Rs.250 + Rs.200, prescribed in Part VIII of the Bar Council of India Rules, under Clauses 1(b) and 1(b-1), to Rs. 1,750/-, and how it is proposed to further enhance to Rs.5,500/- from Rs.1,750/- for filing disciplinary cases/ complaints", the bench observed in the matter.
Advocate Irum Zeba appeared for the petitioner, Deputy Advocate General Mamta Bisht appeared for the State, Advocate Azmeen Sheikh appeared for the Union of India, Advocate Piyush Garg appeared for Bar Council of Uttarakhand, and Advocate Sandeep Tiwari appeared Bar Council of India.
