Whether Parties Want To Put In More Energy For Litigation With Bouquet Of Cases Or Take Reasonable Stand: Supreme Court Remarks In Matrimonial Case
The Supreme Court in a transfer petition has directed the parties in a matrimonial dispute to settle their differences on reasonable grounds amicably rather than fighting a bouquet of cases. The husband and wife in the relationship allegedly contended that they can’t live with each other.
A bench of Justice Sanjay Kishan Kaul and Justice Sudhanshu Dhulia while directing the parties to the Supreme Court Mediation Centre observed, “We have put to learned counsel for the parties whether they want some more energy to be utilized in litigation with a bouquet of cases or they are willing to take a reasonable stand and if they can’t live together, part on acceptable terms”.
AOR Roopansh Purohit appeared for the petitioner and AOR Avijit Roy appeared for the respondent.
In the present matter, the parties due to a matrimonial discord approached the court while seeking a divorce. The parties before the Court had allegedly contended that because of the persistent issues, they could no longer live with each other.
The bench noting the same, referred the parties to the mediation centre to resolve their issues amicably and on reasonable grounds. The counsel for the parties also agreed that the matter may be referred to the Supreme Court Mediation Centre.
While passing the order, the bench further directed, “On the initial date, the parties may join virtually”.
“The parties will join before the Mediation Centre on July 31, 2023 at 2 p.m”, the bench further directed.
The Court while issuing directions, also instructed the Mediator to take endeavors to conclude the mediation proceedings within a period of two months of the said date in the matter.
Earlier, through an order dated April 13, 2023 a bench of Justice Ahsanuddin Amanullah stayed the proceedings in the matter pending before the Court of Judicial Magistrate First Class District- Dibrugarh.
Consequentially, the bench directed the matter to be listed immediately after the mediation report is received.
