Murder Of 12-Year-Old Boy: SC Issues Notice To Delhi Govt On Plea Of Father Seeking CBI Probe
The Supreme Court has sought a response from the Delhi government on a plea filed by a father seeking an investigation by the CBI (Central Bureau of Investigation) into the kidnapping and murder of his 12-year-old boy.
The two-Judge Bench comprising Justice V. Ramasubramanian and Justice Pankaj Mithal said, “Issue notice, returnable in four weeks.” The Bench has issued notices to the CBI, Delhi government, and DCP Crime Branch seeking their reply on the said plea.
Advocate Ashwani Kumar Dubey appeared on behalf of the petitioner in this matter.
In this case, a petition was filed by the father named Satish Kumar, who was a retired Army personnel. He had challenged an order dated December 7, 2022, passed by the Delhi High Court wherein it refused to transfer the case to CBI. The counsel for the petitioner contended before the Apex court that the investigation has not been done in a fair and transparent manner and that the High Court erred in not transferring the investigation to CBI.
As per the prosecution, on September 11, 2014, the wife of the petitioner informed him that their child was missing, as a result of which an FIR was registered the next day under Section 363 of the IPC. Thereafter, their child’s body was recovered in a village, and hence, offences under Sections 302 and 201 of the IPC were added to the FIR.
During the investigation, the police arrested two persons but later both the suspects were released by the police. Being aggrieved by this, the petitioner approached the High Court seeking a transfer of investigation to the CBI and the court ordered the investigation of the case to be transferred to the Crime Branch as the "local police is not able to make any headway".
The High Court in its order said that the Crime Branch investigated and conducted narco-analysis, brain mapping, and polygraph tests on all the suspects who may have committed the crime.
