The Bench of Justice Surya Kant and Justice Ujjal Bhuyan ordered, “We are observing for a fairly long time that parties take full liberty in placing on record black and white photocopies of photographs, mostly which are blurred. The Court was hearing a matter related to eviction and dispossession other than under the Rent Control Act. The Petitioner was an 82-year-old woman. She has health issues. Her solitary residential unit was the subject matter of acquisition. Under the Rehabilitation and Resettlement Policy, the petitioners were entitled to be rehabilitated in a residential unit of 50 sq. met. plinth area. There was a serious dispute with regard to the plinth area of the residential unit offered to the petitioners under the Rehabilitation and Resettlement Policy.
On the previous date, the Court had directed the Collector & District Magistrate, Diu to file his personal affidavit with regard to the plinth area measurement of residential dwelling units offered to the petitioners as well as the status of the basic amenities, illustratively highlighted.
