A fast-track court in Bareilly, Uttar Pradesh, has sentenced a 25-year-old Muslim youth to life imprisonment for illegal conversion, under charges including rape, criminal intimidation, and voluntarily causing hurt.

A complaint was filed by a 22-year-old woman in May 2023, who alleged that he had initially introduced himself as Anand when they met at a coaching class in Bareilly in 2022. He also had the 'kalawa' tied on his wrist.

As per the complaint, Aalim promised to marry the victim and took her to a temple and filled the parting of her hair with vermilion. Immediately after, he took her to a friend's room, established sexual relations with her, and recorded the act. He then blackmailed her with the video, repeatedly raping her and forcing her to undergo an abortion when she became pregnant. Aalim also attempted to coerce her into converting to Islam, and when she refused, he and his family members assaulted her.

His father has also been sentenced to two years in jail for criminal intimidation.

Additional District and Sessions Judge Ravi Kumar Diwakar emphasized that the main goal of “love jihad” is to establish dominance over India under the guise of a demographic war. The Court said in its order in Hindi, “The issue of illegal conversion cannot be taken lightly. Illegal conversion is a big threat to the unity, integrity and sovereignty of the country.”

The Court added, “The main objective of Love Jihad is to establish dominance of India under demographic war and international conspiracy by some anarchist elements of a particular religion. In simple words, love jihad is the practise of Muslim men to marry women from non-Muslim communities by pretending to them in order to convert them to Islam. Illegal conversions through love jihad are carried or made to happen by some anarchist elements of a particular religion or they cooperate in it or are involved in the conspiracy. Some anarchist elements get the above acts done, but the entire religion gets defamed. There is enough evidence for love jihad.”

The Court further stated that a huge amount of money is required, hence, the fact of foreign funding in love jihad cannot be ruled out.

The Court said no one can be given the right to convert by force, by luring or by lying. The Court added, “No matter which religion a person belongs to, he does not have the right to convert illegally. If someone is converted illegally by force, by fraud or by luring, then definitely action should be taken under the Uttar Pradesh Prohibition of Unlawful Conversion of Religion Act, 2021. No matter who that person is.”

The Court further said, “Illegal conversions through love jihad are done to fulfil some other big purpose. If the Indian Government does not stop illegal conversions through love jihad in time, then the country may have to face serious consequences in the future.”

The Court said in the case in question, the plaintiff/victim also belongs to the OBC category and an attempt is being made to convert her illegally through love jihad. “The crime of illegally converting Hindu girls by trapping them in love through Love Jihad is being done on a large scale by a rival gang i.e. syndicate by brain washing the weaker sections of non-Muslims, Scheduled Caste, Scheduled Tribe and OBC communities, women and children and by speaking ill of their religion, by making derogatory comments about the gods and goddesses and by applying psychological pressure and by luring them with various types of temptations like marriage, jobs etc., so that conditions like Pakistan and Bangladesh can be created in India too”, the Court added.

The Court thus while sentencing Mohd. Alim Section 376 (2) (n), 323, 504, 506 of IPC and his father under Section 504 of IPC held that, “From the above analysis, it is proved and proven that in the case in question, the accused Mohd. Alim deceived the plaintiff/victim by telling her his Hindu name Anand, married her and raped her several times, abused her, beat her and threatened her to kill her and the accused Sabir alias Rafiq Ahmed also abused the plaintiff/victim with the intention of insulting her.”
